What Happens If I’m Not Ready?
Probate. Probate has a bad reputation, for good reason. Probate is the court proceeding that heirs must file when a loved-one dies – and it is CONFUSING and EXPENSIVE. This is when we resort to quickly hiring an attorney and regretting not hiring an estate planning attorney earlier.
Legal fees eat up inheritance. Probate is LONG. Loved ones can wait 12-24 months before having access to your funds. Probate court proceedings are PUBLIC. Anyone can see your assets and who gets them. Your assets may go to people you don’t want to inherit.

What About the Kids, Adult Dependants, Pets?
Without an estate plan, judge will decide who raises your minor children and dependents. A judge will decide who is in control of their money. Kids will get their inheritance “outright” at age 18. Your spouse could remarry and cause your assets to go to someone other than your kids. Kids could lose their inheritance if they divorce or spend unwisely.
There are so many risks to NOT having an estate plan.

I’m a worried parent. I’m the daughter of parents whose assets I will eventually have to probate, in part. I’m the granddaughter of grandparents who recently passed with no estate plan in place. I’m the friend and daughter-in-law and business partner to people I want cared for as they age.
Years ago, I put off creating my own revokable living trust and estate plan – but one day, something flipped. Shortly after I had my first child, I hired estate counsel I found by referral and muddled through a process that was anything but easy. While I breathed a sigh of relief to have checked the “to-do” off my list, the process had not gone smoothly even for me as an attorney with knowledgebase. As I moved on and into a career of real estate ventures, foreclosures, commercial management, business development – I knew that estate planning could be done better.
